Medical ailment may lead to cancellation of UAE Labour Card

The labour card of an employee is liable for cancellation in case he/she has an underlying disability or medical ailment that prevents them from resuming work, the Ministry of Human Resources and Emiratisation in UAE said.

An employee who becomes infected with a disease which stands in the way of his work, may have his labour card cancelled, the UAE Ministry said.

This is a service provided to any establishment to cancel the labour card of a worker due to sickness or disease.

But, there are some conditions that need to be followed for cancellation of card under such a category.

A sick cancellation medical letter from a hospital, stamped by Health Ministry, is required to avail this service.

Prior to cancellation of labour card, the worker will have to first cancel his / her visa at General Directorate of Residency and Foreign Affairs or its affiliated centres in the country. They should also have established an electronic signature card.

The application to cancel the card need to be printed and required documents should be scanned at the service centres.

The application is then transferred electronically to the Ministry database for verification to ensure that all required conditions are met with necessary documents.

Rules for sick leave:

You should notify your employer in case you fall sick. According to Article 82 of the UAE Labour Law, in case the worker sustains an illness not caused by any occupational injury, he should notify the employer within two days maximum.

The employer may then take necessary procedures to get a medical examination done, to verify the stated illness.

Article 83 states that a full-time employee is entitled to sick leave not exceeding 90 consecutive or non-consecutive days for a year of service. Article 85 permits the employer to terminate the service of the worker if he/she exhausts sick leaves and is not able to report back to work.
